Background Defensive medicine is physicians’ deviation from standard medical care which is primarily intended either to reduce or avoid medico legal litigation. Although the Federal Ethics Committee review in Ethiopia has shown that applications for medical/surgical error investigation claims are increasing at an alarming rate, there is no study to date done to estimate the degree of defensive practice done by the physicians with an intention of avoiding this increasing legal claim. This study assessed the practice of defensive medicine among (...) highly litigious disciplines (surgery) and described factors associated with its practice. Methods Cross sectional quantitative study using online survey questionnaires was conducted to assess the degree of defensive practice and six factors (age, years of experience, specialty, monthly income, place of practice and previous medico legal history) associated with its practice were assessed among surgeons working in Ethiopia. Results A total of 430 surgeons directly received an online survey questionnaire and 236 of them successfully completed the questionnaire making the response rate 51.2%. Nearly half of the study participants (51.7%) were aware of the concept of defensive medicine and 174 (74%) reported performing one form of defensive practice. Twenty-nine (12.3%) of the participants have legal dispute history, though only 1.3% of them ended up in penalty. Avoiding high risk procedures was the commonest defensive act performed by 60% of the participants, followed by ordering tests unnecessarily (52.1%). Multinomial logistic regression model showed that there was no association between age of the participant, place of practice, year of experience and defensive practice. This model also showed that cardiothoracic and vascular surgeons perform less defensively than surgeons with other specialty with P value of 0.02. Conclusion The practice of defensive medicine is widespread among surveyed Ethiopian surgeons and further studies are required to objectively estimate the effect of defensive practice on the health care system of the country. Policy makers need to develop strategy towards decreasing this high rate of defensive practice. (shrink)

This paper investigates the effect of female representation on the board of directors on corporate response to stakeholders’ demands for increased public reporting about climate change-related risks. We rely on the Carbon Disclosure Project as a sustainability initiative supported by institutional investors. Greenhouse gas emissions measurement and its disclosure to investors can be thought of as a first step toward addressing climate change issues and reducing the firm’s carbon footprint. Based on a sample of publicly listed Canadian firms over the (...) period 2008–2014, we find that the likelihood of voluntary climate change disclosure increases with women percentage on boards. We also find evidence that supports critical mass theory with regard to board gender diversity. These findings reinforce initiatives being undertaken around the world to promote gender diversity in corporate governance while demonstrating board effectiveness in stakeholder management. (shrink)

ABSTRACT Banks provide a valuable but inherently unstable combination of deposit‐taking and lending functions that were successfully held together for several decades after the New Deal by tough banking rules. The weakening of the rules after the 1970s promoted the displacement of traditional relationship‐based banking with securitized, arms‐length alternatives that encouraged banks to undertake activities about which bankers lacked deep relationship‐based knowledge of the risks. Ironically, this risky behavior, encouraged by loosened regulation, was reinforced by progressively tightened securities regulation, which (...) promoted stock‐market liquidity but also deprived large banks (and other publicly traded companies) of oversight by investors with “insiders’” knowledge. Both the underregulation of banking and the overregulation of securities were underpinned by economic theories that favored blind diversification in liquid, anonymous markets, and that ignored the value of relationship‐based knowledge and case‐by‐case due diligence. Dhall (2010) posited that quantum holism can provide an alternate justification for human rights. This article explores how such a foundation challenges aspects of international law and assertions of cultural relativism that have stymied the ongoing development of a universal human rights culture.

El artículo indaga en la reemergencia de ciertos principios que la Edad Media vinculó al pensamiento de Averroes en pensadores contemporáneos como Giorgio Agamben, Roberto Esposito, Emanuele Coccia y Jean Baptiste Brenet. La eternidad del mundo y la separación del itnelecto vuelven a aparecer como sustento de una filosofía capaz de poner en tela de juicio ideas fundamentales de la modernidad como la de sujeto o persona, sin por ello entramparse en el nihilismo.

We propose a semantic analysis of the particles afinal (European Portuguese) and alla fine (Italian) in terms of the notion of truth unpersistence, which combines both epistemic modality and constraints on discourse structure. We argue that the felicitous use of these modal particles requires that the truth of a proposition p* fail to persist through a temporal succession of epistemic states, where p* is incompatible with the proposition modified by afinal/alla fine, and that the interlocutors share knowledge of a previous (...) epistemic attitude toward p*. We analyze two main cases, that of plan-related propositions and that of propositions without plans. We also discuss the connections between truth unpersistence and evidentiality. (shrink)

Giorgio Agamben’s concepts of ‘the sovereign’, ‘state of exception’ and ‘bare life’ have been used by political theorists, particularly since the declaration of the Global War on Terror and during the more recent age of wars of humanitarian intervention, to conceptualize the sovereignty exercised by security states. These state processes have been mirrored by absolutization within some branches of political theory, conflating Foucauldian concepts of biopolitical sovereignty and circulatory governmentality with notions of absolutist rule, and narrowing optics for interpreting popular (...) mobilizations around gendered ‘human security’ projects, emergency regimes and moralizing repression. Suggesting more productive directions for theory, this article generates a close reading of female activists working in an unexpected industry in Egypt who have struggled to invert and subvert absolutist and moralizing framings and have generated their own theory through practice. The ‘Natashas of Cairo’ – well organized and transnationally linked belly dancers – successfully promoted gendered popular sovereignty in remarkable campaigns between 2002 and 2006, utilizing personal-rights litigation to create frameworks to render the absolutist state more accountable; establish labor solidarities that crossed international boundaries as well as class boundaries; and articulate an alternative moral regime for dance work that rejected both ‘pornification’ and the ‘respectability politics’ of professionalization. He showed how the political action of his contemporaries was something excessively ineffective to answer the wishes of a fair society, integrated by several people and races. This society, that had conquered in history, with mistakes and cleverness, power and glory, booth in the field of science and technology, for itself, the ways that (...) make sure to its citizens a prosper life, gradually succumbed. Thus, this article aims to exposes to the reader some aspects experienced by this society and make note that when policy is practiced by men who possess as premises the power and his own advantages, there is no richness or organization that will sustain such state or nation. Multidimensional practical demand has made Islamology one of the most "trendy" branches of Oriental studies and has created a host of serious difficulties and problems associated with an adequate scientific response to the "Islamic challenge". Excessive politicization of the study of such a phenomenon as Islamic fundamentalism, radicalism in the world, undoubtedly, undermines the true scientific knowledge, preventing the specialists from understanding this complex phenomenon.

Recently, the second author, Briseid, and Safarik introduced nonstandard Dialectica, a functional interpretation capable of eliminating instances of familiar principles of nonstandard arithmetic—including overspill, underspill, and generalizations to higher types—from proofs. We show that the properties of this interpretation are mirrored by first-order logic in a constructive sheaf model of nonstandard arithmetic due to Moerdijk, later developed by Palmgren, and draw some new connections between nonstandard principles and principles that are rejected by strict constructivism. Furthermore, we introduce a variant of (...) the Diller–Nahm interpretation with two different kinds of quantifiers, similar to Hernest’s light Dialectica interpretation, and show that one can obtain nonstandard Dialectica by weakening the computational content of the existential quantifiers—a process called herbrandization. We also define a constructive sheaf model mirroring this new functional interpretation, and show that the process of herbrandization has a clear meaning in terms of these sheaf models. (shrink)

O presente artigo explica o que é e como funciona o método de análise lógica de Russell no contexto do atomismo lógico, apontando os objetivos e preceitos que ele leva em conta quando se propõe a fazer análises proposicionais. Após explorar o desenvolvimento geral da análise em sua obra, examinamos dois exemplos de análise proposicional: o de proposições relacionais e o de proposições que contêm descrições. Nos dois casos, notamos que Russell busca romper com uma lógica restrita à forma sujeito-predicado, (...) que ele pensava ser a origem de uma gramática defectiva e, por isso, também de muitos dos problemas metafísicos tradicionais. Neste sentido, presumindo que pode haver uma ampla variedade de formas, Russell pensa que o objetivo da análise seria justamente identificar qual é a forma lógica e quais são os constituintes de uma proposição, o que serviria para desfazer mal-entendidos da linguagem e dissolver problemas metafísicos. Portanto, no presente artigo, detalhamos sob quais preceitos teóricos Russell realiza esse objetivo nos dois exemplos especificados. (shrink)

This paper focuses on the interpretation of the Italian approximative adverb quasi 'almost' by primarily looking at cases in which it modifies temporal connectives, a domain which, to our knowledge, has been largely unexplored thus far. Consideration of this domain supports the need for a scalar account of the semantics of quasi (close in spirit to Hitzeman's semantic analysis of almost, in: Canakis et al. (eds) Papers from the 28th regional meeting of the Chicago Linguistic Society, 1992). When paired with (...) suitable analyses of temporal connectives, such an account can provide a simple explanation of the patterns of implication that are observed when quasi modifies locational (e. g. quando 'when'), directional (e. g. fino 'until' and da 'since'), and event-sequencing temporal connectives (e. g. prima 'before' and dopo ' after'). A challenging empirical phenomenon that is observed is a contrast between the modification of fino and da by quasi, on the one hand, and the modification of prima and dopo by the same adverb, on the other. While quasi fino and quasi da behave symmetrically, a puzzling asymmetry is observed between quasi prima and quasi dopo. To explain the asymmetry, we propose an analysis of prima and dopo on which the former has the meaning of the temporal comparative più presto 'earlier', while the latter is seen as an atomic predicate denoting temporal succession between events (Del Prete, Nat Lang Semantics 16: 157-203, 2008). We show that the same pattern of implication observed for quasi prima is attested when quasi modifies overt comparatives, and propose a pragmatic analysis of this pattern that uniformly applies to both cases, thus providing new evidence for the claim that prima is underlyingly a comparative. A major point of this paper is a discussion of the notion of scale which is relevant for the semantics of quasi', in particular, we show that the notion of Horn (entailment-based) scale is not well-suited for handling modification of temporal connectives, and that a more general notion of scale is required in order to provide a uniform analysis of quasi as a cross-categorial modifier. Em vista da grande multiplicidade de linguagens e considerando que a alfabetização é uma importante prática de letramento na constituição da criança, este artigo tem o objetivo de identificar o tipo de abordagem dado à imagem em um livro didático do 1º ano, aprovado pelo PNLD. O intuito é discutir em que medida a amostra analisada favorece uma leitura compreensiva e crítica do texto imagético. Para tanto, as ponderações foram realizadas por meio de uma epistemologia interpretativa, à luz da teoria (...) dos letramentos sob uma perspectiva sociocultural, e também a partir da sintaxe da linguagem visual, que pode trazer uma contribuição positiva às análises discursivas visuais. A pesquisa indica que a imagem é proposta a partir de perspectivas socioculturais; que as atividades de leitura favorecem o letramento visual e que a condução do professor pode fazer diferença nas abordagens e leituras.Considering the multitude of languages and the fact that beginning literacy is a key literacy practice in children's education, we aim at identifying how images are approached in a textbook used in the first grade of elementary school and accredited by Brazil's National Textbook Program. We also seek to discuss the extent to which the analyzed sample provides a comprehensive and critical reading of visual texts. The analysis was done based on interpretive epistemology, the sociocultural approach to literacy, and visual language syntax, which can contribute positively to the analysis of visual discourse. We concluded that the image in the sample is presented from sociocultural approaches, that the reading activities foster visual literacy, and that teachers' support plays a significant role in adopting approaches to reading and in conducting reading activities per se. Este artigo começa por proceder à caracterização do Estado soberano, perspectivando-o como forma concreta e historicamente situada de organização política e inserindo-o no contexto dos demais modelos que o precederam. De seguida, constata a profunda crise que sobre ele se abateu, manifesta na incapacidade que apresenta, seja para explicar os fenómenos políticos com que nos deparamos diariamente, seja para constituir matriz adequada para a compreensão e explicação do mundo em que vivemos. Por último, lembra os direitos do homem desenvolvidos na (...) sequência da II Guerra Mundial do último século, explorando, por um lado, o carácter profundamente inovador que assumem e, por outro, a revolução que vêm introduzindo no sistema estatal de organização política. Tudo isto em apoio do principal argumento que se apresenta: quebrando o monopólio sobre o direito e o poder político que a modernidade havia consignado aos Estados, os direitos do homem emergem como uma das exigências mais eloquentes de um modelo novo de organização social e política, capaz de corresponder às necessidades que se fazem sentir, de universalidade, de solidariedade e de integração, também em termos jurídicos e políticos. /// This article opens with a characterization of the sovereign State, understood as a material and historically situated form of political organization and inserted in the context of the models that preceded it. In a second moment, it witnesses the profound crisis that has befallen it, evident in its incapacity, either to explain the political phenomenon we face daily, or to constitute an adequate framework for the under-standing and the explanation of the world we live in. Finally, it looks at human rights, as developed after the Second World War of the last century, exploring, on the one hand, their profoundly innovative character and, on the other, the revolution they are introducing in the State system of political organization. Beginning with one of the most remarkable characteristics of cyber art, ‘interactivity’, in a context of generalized hybridization of the procedures and technological devices available in the current hyper-technological era, this article will highlight the festive dimension within contemporary artistic practices, especially in its technological and digital components. In order to take both its ‘creationist’ and ‘reflexionist’ aspects into consideration, the proposed interpretation will adopt as its starting point the questions introduced by classical anthropology about festivity: What establishes community in (...) cyber art? Which kind of community is established there and what is sacrificed in digital or cybernetic art? These questions are articulated with the discussion proposed by Hans-Georg Gadamer and Richard Schechner about the task of building the reflexive play that is found in the work of art as such. The purpose is to gradually present, throughout the article, the peculiarity of the experience of ‘the festive’ in computing and numerical arts. (shrink)

The works of Sade portray the corrupt and libertine practices at the time of Louis XV's despotic regime, invariably referring to the boudoir as a privileged place for the transformation of mind and body as well as for philosophical production. The actuality of Sade's thought lies in the fact that he reveals - as do modem trends - the narcissic constitution of subjectivity that, in its social-political aspect, leads to political conformism. This article aims at presenting Sade's thought as a (...) radical critique of social relationships, which lead to the rupture of Rousseau's social contract. His relentless doctrine becomes negative philosophy in that it supplies the foundations for the critique of instrumental reason. A pessimist regarding the course of social totality, Sade's theory points to human 'animality' as a possible means of transcending the artificiality of social relationships.As obras de Sade procuram retratar as práticas corruptas e libertinas presentes no regime despótico de Luís XV, apontando invariavelmente a "alcova" como lugar privilegiado de transformação do corpo e da mente e, ao mesmo tempo, de produção filosófica. A atualidade do pensamento de Sade revela-se no fato de colocar como tendencia da modernidade, a constituição narcísica da subjetividade que, em sua variante político-social, aparece sob a forma do conformismo político. Este artigo pretende apresentar o pensamento de Sade como urna crítica aos liames sociais, o que conduz à ruptura da idéia de pacto social formulada por Rousseau. A doutrina sem compaixão de Sade torna-se filosofia negativa na medida em que fornece os fundamentos da crítica à razão instrumental. Sendo pessimista quanto aos rumos do existente, a teoria sadiana aponta a "animalidade" humana como possibilidade de transcendencia da artificialidade dos laços sociais. (shrink)

A teoria literária ofereceu uma contribuição definitiva ao conhecimento histórico, sobretudo se coadunada com uma discussão propriamente epistemológica sobre o seu papel enquanto representação literária. Partindo desta assertiva concordamos que o texto literário cobra um lugar de primeira importância para o conhecimento histórico, pois todo o conhecimento possível do “passado”, enquanto testemunho escrito, nele se constitui enquanto representação e dele emerge para ser de novo reapresentado. Daqui partiremos, ao propor um modus operandi por meio do qual uma fonte literária medieval (...) pode ser apreendida como fonte histórica, ao considerar precisamente conceitos literários, como o individuo e o autor. For humans, Artificial Intelligence operates more like a Rorschach test, as it is expected that intelligent machines will reflect humans' cognitive and physical behaviours. The concept of intelligence, however, is often confused with consciousness, and it is believed that the progress of intelligent machines will eventually result in them becoming conscious in the future. Nevertheless, what is overlooked is how the exploration of Artificial Intelligence also pertains to the development of human consciousness. An excellent example of this can be seen (...) in the film Being John Malkovich (1999). In the film, different characters have their perceptions altered as a result of hacking into the mind of John Malkovich, which produces sensations that may have remained hidden to their consciousness due to their dis-abilities. This article engages with the research question: Can the symbiotic relationship between humans and machines trigger an artificial consciousness for humans? An artificially created consciousness is the premise that a machine can generate knowledge about an individual that is not already present in the person. For the same purpose, the article takes the cinematic text Being John Malkovich by Spike Jonze for exploring concepts such as human/robot rights, virtual sex, virtual rape, and bodily disability, which are essential topics in the midst of increasing human- Artificial Intelligence interaction. The purpose of this article is to contribute towards the creation of a better understanding of Artificial Intelligence, particularly from the perspective of film studies and philosophy, by highlighting the potential of Artificial Intelligence as a vessel for exploring human consciousness. Situado no campo da discussão entre a filosofia da vida e a fenomenologia, ou mais especificamente entre a escola diltheiana e o círculo fenomenológico, o artigo investiga em que esfera Dilthey é, de fato, relativista, e, no caso afirmativo, até que ponto é possível extrair, de sua posição diante da história, consequências céticas.

Talvez “redescobrimento” seja uma caracterização adequada para designar o _status_ do movimento neokantiano atualmente. Se, por um lado, o neokantismo tem recebido uma maior atenção em diversos lugares da Europa, América do norte, Ásia, e em alguns países da América Latina, por outro, na ainda jovem cultura filosófica brasileira, o estudo desse importante e decisivo movimento é algo atípico dentro de nossas instituições de ensino, para dizer o mínimo. De fato, a quantidade de trabalhos acadêmicos, artigos e livros sobre as (...) filosofias de autores como Cassirer, Windelband, Cohen, Lask, Natorp, Rickert e tantos outros que fizeram parte desse plural movimento filosófico está muito aquém do que eles realmente merecem. Sem dúvidas, esse “acerto de contas” com tais personagens seria uma tarefa muito mais árdua se não tivéssemos à nossa disposição os _Estudos_ _Neokantianos_, do Professor Mario Ariel González Porta. This article explores the traditional basis of modern human rights doctrines and exposes some of the systemic shortcomings. It then posits that a number of these problems are advanced via integrating some developments in the philosophy of science and substantive scientific research into legal philosophy. This article argues that supervening holism grounded in quantum mechanics provides an alternative basis to human rights by positing an ontological construct that is congruous with many of the wisdom traditions practiced around the world. This thesis considers the space of encounter between the quantum mechanical ontology of limited universal holism and the legal system. This space of encounter is identified through an examination of two premises. The first premise is that the ontological structure of limited universal holism has significant legal philosophical and socio-­‐legal implications. The second premise is that the loci of commitment within the ontology of limited universal holism epistemologically coheres with the core ontological notions that underpin the Preamble of the Universal (...) Declaration of Human Rights of 1948,1 specifically the notions of equality, universality and inalienability. Both premises are affirmed in the course of analysis undertaken in this thesis. In addition some novel contributions are posited. Some of the ontological elements of limited universal holism when deployed as heuristic tools show, inter alia, coherence between the way socio-­‐legal constructivists conceptualise the law and the wave-­‐particle duality of quanta. In respect of the second premise, epistemological coherence is shown between the ethos that underpins modern human rights and the loci of commitment within the ontology of limited universal holism. This coherence improves the epistemic stability of monist perspectives on which deep equality may be framed. The thesis concludes with some suggestions for future research. Two particularly exciting areas for future research are uncovered in the course of the analysis. First is the coherence between the work in this thesis and the jurisprudential paradigm of Wild Law. Second is the potential for the monist ontology of limited universal holism derived from scientific research to cohere with many diverse wisdom and ethno-­‐cultural traditions and in so doing increase the epistemic standing of monist ontologies. In September 2018, a controversial judicial sentence concerning sexual violence caused a public outcry in Portugal. The court decision invoked the alleged environment of mutual seduction, the use of much alcohol consumption, and the lack of serious injuries to justify the suspended penalty. Stemming from the idea that understandings of what journalism is and what it should be are profoundly ideological and that notions of what it means to be and to behave like a woman and as a man have (...) been developed based on shifting realities within generalised patriarchal structures, this article intends to critically analyse the news media coverage of the controversial judicial sentence on this rape case in Portugal exploring the implications objective-based journalism entails for gender equality. As such, it will identify the shortcomings of objectivity and its leeway when covering sexual violence exploring how objective-based journalism provides room to negotiate practices, norms, identities, and meanings concerning sexual violence, particularly rape and rape myths, and questioning whether a margin of maneuvre is enough to deconstruct patriarchal assumptions of feminity, masculinity and sexuality.
